National Changes in Real Estate Commissions
Recent changes in real estate impact how homes are sold. Working with knowledgeable agents is crucial for getting the best price in today’s market. The national conversation around Real Estate commissions has been widespread and the news reports have been to a certain degree misleading.
Changes are being made as part of a settlement to the national lawsuit brought against the National Association of Realtors relating to how commissions are paid.The first change is that a seller’s agent can no longer offer a buyer’s agent commission in the MLS effective August 17, 2024.
Why? Because it seemed to be a conflict of interest for a seller to offer a commission to a buyer’s agent. It was felt that the buyer’s agent would tend to lean toward the seller’s interest and some claim that it caused home price to go up. The second change is Buyers must now sign a Buyer/Broker agreement. Buyers are responsible for compensating their agents. You are not required to pay this cost.
Can you still pay a buyer’s agent commission? Yes! Buyers have historically relied on sellers, through the listing agent, to provide that compensation to the buyer’s agent on the buyer’s behalf.
Do I have to pay a buyer’s agent commission? No, but in the absence of an offer of compensation, buyers have to solve that financial issue on top of the other costs they incur. Buyers will be looking for sellers who are providing compensation to the buyer’s agent so they don’t need to.
Not offering compensation will exclude buyers who cannot afford to compensate their agents in addition to the down payment and closing costs.
One group of buyers are VA buyers. Active and retired service members are not allowed to pay more than 1% of the purchase price beyond the closing costs, and commission is not an allowed closing cost.
